Terms of Use

1. Seller and Contact Information

Epochgram is provided by Andriy Babets (PE) ("Epochgram", "we", "us", or "our").

These Terms of Use ("Terms") govern your access to and use of the official distribution of Epochgram, including the Epochgram website, documentation, and the Epochgram plugin for Obsidian (the "Product").

By accessing, downloading, purchasing, activating, or using the Product, you agree to these Terms. If you do not agree, do not access or use the Product.

Open Source Note: The source code for the Epochgram plugin is released under the MIT License. While you are free to use, copy, and modify the source code under those terms, these Terms of Use specifically govern the official distribution of the Product, the Epochgram trademarks, and the Pro services (licensing, hosted functionality, and support) provided by us.

3. Orders and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

4. Eligibility

You may use the Product only if you are legally able to enter into a binding agreement.

5. Product License and Trademarks

Subject to these Terms and payment of any applicable fees, we grant you a limited license to access and use the official distribution of the Product and its Pro features.

Your rights to the source code of the Product are governed by the MIT License. However, these Terms do not grant you any rights to use the "Epochgram" name, logo, or related branding. Any distribution of a modified version of the source code (a "fork") by a third party must be clearly rebranded, must not use the name "Epochgram", and must not imply any affiliation with or endorsement by us.

For the Epochgram website, documentation, branding, trademarks, Pro entitlements, license keys, activation and verification services, hosted functionality, and any other materials or services not expressly released under the MIT License, all rights are reserved.

6. Plans, Pricing, and Pro Features

Epochgram may be offered under different commercial models, including lifetime licenses and recurring subscriptions for Pro features. Pro features (such as AI-powered tools or advanced visualizations) are provided as a service through our official distribution.

Unless expressly stated otherwise at checkout, the specific plan, included features, usage limits, price, and billing terms presented at the time of purchase apply.

7. Device Limit

Unless expressly stated otherwise at checkout, one Epochgram Pro license may be activated on up to five (5) devices maximum, provided those activations are for the same individual user. You may not share, transfer, or resell your Pro license key to any third party.

8. Activation and License Verification

Epochgram Pro features require activation through our licensing service. To maintain Pro license validity, the Product may periodically verify paid entitlements with our cloud service.

License verification may process data reasonably necessary to validate the license and prevent abuse, including:

email address
transaction details
device identifier
IP address and user-agent
license key

If we detect misuse, unauthorized sharing, or circumvention of licensing controls, we may suspend or revoke the relevant Pro license.

9. Acceptable Use and Restrictions

You may not, except where such restriction is prohibited by applicable law:

use Epochgram branding, trademarks, or proprietary materials to market a competing product
bypass, disable, or circumvent activation or licensing mechanisms of the official distribution
use the official Product or hosted services in a way that infringes the rights of others or violates applicable law

10. Open-Source and Third-Party Components

The Product's source code is released under the MIT License. If these Terms conflict with the MIT License regarding the use of the source code, the MIT License controls for that code. These Terms continue to apply to the official distribution, branding, and Pro services.

11. Updates, Changes, and Availability

We may release updates or modify features of the official distribution at any time. While the open-source code remains available, we do not guarantee the indefinite availability of cloud-based Pro services or third-party integrations.

12. Support

Support is offered at our discretion by email at hi@epochgram.com. Official support for the Product distribution is prioritized for Pro users.

13. Intellectual Property

Except for materials expressly released under the MIT License, the Product distribution, website, branding, trademarks, and licensing systems are owned by Andriy Babets (PE) and protected by intellectual property laws. All rights not expressly granted are reserved.

14. Disclaimer

The Product is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties. You are solely responsible for maintaining backups of your Obsidian vaults and data used with the Product.

15. Limitation of Liability

Our total aggregate liability arising out of or relating to the Product or these Terms will not exceed the amount you paid for the Product. We are not liable for any indirect, incidental, or consequential damages.

16. Termination

These Terms apply for as long as you use the Product. We may terminate your license to Pro features if you materially breach these Terms. Termination does not limit rights granted under the MIT License for the source code, provided you comply with that license.

Refund Policy

17. Refunds

If you are not satisfied with your purchase, you may request a refund within fourteen (14) days of the original purchase date. To request a refund, contact hi@epochgram.com with your order details. Refunds are returned to the original payment method via Paddle.

Privacy Policy

18. Data We Process

Depending on your interaction with Epochgram, we may process:

email address and transaction details (via Paddle)
license key and device identifier
IP address and user-agent
support communications
anonymized website analytics (via Vercel)

19. How We Use Data

We use personal data to:

operate the licensing system and Pro features
enforce license limits and prevent fraud
respond to support requests
send product updates and marketing communications (where permitted or consented)
